Please review the following which represent the agreement between Cheesecakesbysam and the customer.

​

PLEASE READ THESE TERMS IN FULL

Please review your invoice, the date, the cake flavors, size, design theme/style, and any attachments including inspiration photos.

These details note the final decision made between Cheesecakesbysam and the customer for the order.

​

If, for any reason, you do not agree to any of the details noted in the invoice prior to payment, you are welcome to decline the order by sending an email to Cheesecakesbysam.

​

Orders canceled after payment has been made are subject to the terms below.

Your payment serves as a signature & agreement to these terms.

CANCELLED, POSTPONED, OR RESCHEDULED ORDERS

​

In the event that you need to cancel, postpone, or reschedule your order & Cheesecakesbysam is notified at least 2 weeks in advance, we will honor your deposit and/or full payment made.

Cheesecakesbysam will not accept orders placed no more than 3-4 days in advance.

​

Postpone: to put off an event with a date unknown.

Reschedule: to schedule again with a new time & date

set.

​

Rescheduling is subject to Cheesecakesbysam calendar & availability.

​

 

PICKUP

DELIVERY

PICKUP

Cheesecakesbysam is located in Perry, NY. In the event of a pickup request, Cheesecakesbysam will notity the customer 72 hours before the date of pickup for confirmation. The customer agrees to communicate an approximate time that the cakes will be picked up. Walk-ins are not acceptable.

​

Failure to pickup the order at the approximate time will result in Cheesecakesbysam putting the order on hold. Cheesecakesbysam will allow 30 minutes after the given time for the order to be picked up.

​

If an order is not picked up on the due date of the invoice, the customer may try again the following day. Rescheduling pickup is subject to Cheesecakesbysam calendar availability.

​

In the event of a pickup order being changed to delivery on the day of or following, the customer agrees to a $20.00 service charge added to their order.

 

DELIVERY

All orders that are to be delivered over 5 miles agree to pay a $10.00 delivery fee. Cheesecakesbysam will deliver orders upon the customers' request. The delivery date of the order is due at the time of ordering. 

Delivery orders must be confirmed at least 72 hours before delivery date and the customer agrees to communicate with Cheesecakesbysam an approximate time of delivery.

In the event of a delivery order being made but the customer not being present, Cheesecakesbysam will allow 15 minutes after arrival for the order to be collected.

​

Failure to collect the order will result in Cheesecakesbysam putting the order on hold. An order on hold may be delivered at a later time subject to Cheesecakesbysam calendar availability.

The customer agrees to pay a $30.00 service charge for orders that have to be re-delivered.

​

PLEASE BE AWARE:

Cheesecakesbysam will charge an extra $5.00 for every additional 10 miles driven for delivery orders.

RETAINER & FINAL

PAYMENT

​

RETAINER

A 25% non-refundable retainer for standard cakes and a 30% non-refundable retainer for specialty cakes is due within 48 hours of the invoice being sent in order to secure the order date.

$50.00 standard cake = $10.00

$60.00 specialty cake = $15.00

​

Orders will not be confirmed & added to

Cheesecakesbysam until the retainer is paid, to allow all interested customers a chance to book.

​

Your order will be canceled & your date may become unavailable in the event your retainer is not received within 48 hours.

​

FINAL PAYMENT

Final payment for your order is due no later than 72 hours before pickup or delivery and 2 weeks before for all wedding and catering orders.

 

REFUNDS & DISCLAIMER

REFUNDS

In the event of an order cancellation less than 2 weeks in advance, Cheesecakesbysam is not required to refund any payment charged for any order. As noted above, in the event you cancel the order, postpone, or reschedule, at least 2 weeks in advance, Cheesecakesbysam is required to refund any payment charged for any order.

DISCLAIMER

Important note about allergens:

Cheesecakesbysam products may contain traces of nuts, including peanuts and hazelnuts, as well as gluten, dairy, and eggs. As a result, they may not be suitable for individuals with allergies or intolerances. The following allergens are also used in the kitchen: milk, eggs, fish, crustacean shellfish, tree nuts, wheat, and soybeans.

PACKAGING & CARE

​

CARE

Cheesecakesbysam will notify you of care instructions prior to or during pickup or delivery. You are responsible for providing a level surface & suitable environment for your desserts. It is strongly advised to bring a cooler or freezer bag large enough for a 10 x 10 x 5 box.

​

We strongly advise against placing your cakes outdoors or in direct sunlight. Cheesecakesbysam is not responsible for any damages to your order due to outside elements.

Cakes must be kept refrigerated and should be left at room temperature for no more than 3 hours.

​

PACKAGING

Your cakes will always be packaged appropriately and secure for travel. It is best to place your cakes on a flat surface such as the floor of the car or trunk. Your cake should never be placed on an uneven surface such as the seat of the car.

LIABILITY & CHANGES

LIABILITY

Cheesecakesbysam is not liable for any damage that may arise related to your cake once your order has been picked up or delivered.

​

CHANGES

It is your responsibility to thoroughly review all details of your order prior to payment. If Cheesecakesbysam is not notified of any changes to be made before submitting the final payment, we will assume your agreement and move forward with fulfilling the order according to the invoice details.

SERVINGS & DECOR​

SERVINGS

The serving size noted on the order form is based on personal research. Cheesecakesbysam is not responsible for cake serving shortage.

​

CAKE CUTTING

Cheesecakesbysam offers cake cutting with an additional fee of $10.00. Cakes can be cut up to 16 slices. 8, 10, and 12 slices are advised for optimal enjoyment.

​

INEDIBLE DECOR

While hardly used, inedible decor such as silk florals, candles, cake toppers, etc. are to be removed before consumption. Inedible decor will only be used per the customers request and Cheesecakesbysam will notify the customer about the inedible decor.
